Terms of Service

1. Agreement

By purchasing, downloading, or using SimOffice, you agree to these Terms of Service. If you do not agree, do not use the software.

2. License

CrashOverride LLC grants you a limited, non-exclusive, non-transferable, revocable license to use SimOffice for personal or business purposes, subject to an active subscription. You may not:

Copy, modify, distribute, sell, or sublicense the software
Reverse engineer, decompile, or disassemble the software
Share your subscription or download links with others
Use the software for any unlawful purpose

3. Subscription & Billing

SimOffice is offered as a monthly subscription at $50/month.
A 24-hour free trial is included. You will not be charged during the trial period.
After the trial, your payment method will be charged automatically each month.
You may cancel at any time. Cancellation takes effect at the end of the current billing period.
No refunds are provided for partial months.

4. Updates

Active subscribers receive access to all software updates. If your subscription lapses, you may continue using the last version you downloaded, but you will not receive future updates or support.

5. AI Services

SimOffice connects to third-party AI providers (e.g., Anthropic, OpenAI, Google, xAI, Ollama). You are responsible for:

Providing your own API keys for these services
Any costs incurred from using those services
Complying with the terms of service of those providers

CrashOverride LLC is not responsible for the output, availability, or pricing of third-party AI services.

6. Your Data & Responsibility

SimOffice acts as an interface between you and third-party services (AI providers, CRMs, messaging platforms, etc.). You acknowledge and agree that:

You are solely responsible for your data. SimOffice does not store, process, or control the data you send to or receive from third-party services. Your data flows directly between your device and those services.
AI outputs are not guaranteed. AI-generated content (responses, actions, recommendations) may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing and verifying all AI output before relying on it.
Third-party integrations are at your own risk. When you connect services (HubSpot, Slack, GitHub, etc.), SimOffice sends data to those services using credentials you provide. CrashOverride LLC is not responsible for how those services handle your data, any data loss, corruption, or unauthorized access that occurs through those services.
API keys and credentials are your responsibility. You are responsible for securing your API keys, tokens, and credentials. CrashOverride LLC is not liable for any unauthorized access or charges resulting from compromised credentials.
You assume all risk for actions taken by AI agents. AI agents may send messages, create records, modify data, or take other actions on connected platforms on your behalf. You are solely responsible for the consequences of those actions.
Back up your data. CrashOverride LLC is not responsible for any data loss, including but not limited to files, configurations, conversations, contacts, or records, whether caused by software errors, AI actions, system failures, or any other reason.

7. Disclaimer of Warranties

SimOffice is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. CrashOverride LLC does not warrant that:

The software will be error-free, uninterrupted, or secure
AI-generated outputs will be accurate, complete, or appropriate
Third-party integrations will function correctly or continuously
Your data will be preserved, protected, or recoverable
The software will not cause damage to your system, data, or connected services

8. Limitation of Liability

To the maximum extent permitted by law, CrashOverride LLC shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

Your use of or inability to use SimOffice
Any actions taken by AI agents on your behalf
Data loss, corruption, or unauthorized access
Errors, inaccuracies, or omissions in AI-generated content
Interruption or failure of third-party services or integrations
Any costs incurred from third-party AI providers, APIs, or services
Damage to your computer, software, data, or connected systems

In no event shall CrashOverride LLC's total liability exceed the amount you paid for SimOffice in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless CrashOverride LLC from any claims, damages, losses, or expenses (including legal fees) arising from your use of SimOffice, your violation of these terms, or any actions taken by AI agents operating under your account.

10. Termination

CrashOverride LLC reserves the right to terminate your access to SimOffice at any time, for any reason, with or without notice.

11. Changes

We may update these terms at any time. Continued use of SimOffice after changes constitutes acceptance of the updated terms.
